These Terms govern your use of the referral services provided by Arabian Views, LLC (“we,” “us,” or “our”). By contacting our call center or otherwise using our services, you agree to be bound by these Terms.
1. Our Services
We act as an independent referral agent. We provide a service that connects consumers with third-party service providers (“Service Providers”) for products and services such as high-speed internet, television, phone, and home security. We use a technology platform provided by Updater Inc. to facilitate these referrals and order submissions.
We are not a service provider. The actual products and services are delivered solely by the Service Providers (e.g., AT&T, Comcast, CenturyLink). The terms, conditions, prices, and service level agreements for those products and services are set by the Service Providers, not by us.
2. User Responsibilities
By using our services, you agree to:
- Provide accurate, current, and complete information.
- Be bound by the terms and conditions and privacy policies of the Service Providers you select.
- Consent to the recording of calls for quality assurance and compliance purposes.
3. Intellectual Property
All technology, software, and content provided to you through our services, including the Updater Services platform, are the property of Arabian Views, LLC, Updater Inc., or their licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services solely for the purpose of seeking referrals to Service Providers.
4. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE AVAILABILITY, QUALITY, OR PRICING OF ANY SERVICES OFFERED BY THE SERVICE PROVIDERS.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ARABIAN VIEWS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OUR SERVICES OR YOUR INTERACTION WITH ANY SERVICE PROVIDER.
6. Indemnification
You agree to indemnify and hold harmless Arabian Views, LLC and its owners, officers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Maricopa County, Arizona.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and update the “Last Updated” date. Your continued use of our services after any change constitutes your acceptance of the new Terms.
